The practice referred to in the words repealed in practically obsolete; but after further consultation with the magistrates I have decided to retain it, as it is a privilege, and should not be taken away from the accused. I have however in accordance with their suggestion inserted in s. 72(2) words to ensure (what is the practice) that the depositions should be read over to the wit- -nesses in the presence of the accused.

It will be convenient at this point to explain another amendment in relation to evidence, introduced into s. 32 of No. 2 of 1889. The section relates to dying, depositions. It is practically copied from the English Act, but it is badly worded and confused.The practice has however taken definite shape and the section in its new form accords with that practice.

(xi) and (xii) already corrected.

(xiii) *s. 61* is a misprint for "s. 62" and had been already

corrected.

(xiv) the sub-sections referred to are repealed; (2) because it is provided for generally; (3) because it is incorporated.

(xv) the definition of "motor-boat" is contained in No. 9 of 1909 which is now incorporated with No. 10 of 1899.

(xvi) "misdemeanor" was a misprint for "felony" and the correction had already been made.

(xvii), (xviii), (xix) and (xx) already corrected.

(xxi) I agree with the criticism, but the form was necessary on account of the use of the words "Life Insurance" in the title and sub-title, in which the substitution of the word "company" could

not be made.

(xxii), (xxiii), and (xxiv) already corrected.

(xxv) I think it better to repeal these Ordinances expressly as they had been inadvertently left on the Statute Book, and there is now an express reference to their repeal.

(xxvi) item (63) introduced by No. 23 of 1903, s. 25.
